Section 445
Pledged property

(1) Someone can re-mortgage the mortgaged property or any part of it for an amount equal to or less than the amount mentioned in the relevant document and re-mortgaging it will be considered as a mortgage. .
(2) The period of enjoyment of the bond granted under sub-section (1) cannot exceed the period of enjoyment under the bond.
(3) If the person who has the right and ownership in the property wants to take back the property pledged as per sub-section (1), if the amount at the time of giving the pledge is equal to the initial pledge, he can directly pay the pledge from the person taking the pledge, and if the amount is less than that amount, he can take back the property by paying the pledge through the creditor who gave the pledge at the beginning.
(4) Notwithstanding anything written elsewhere in this section, the transaction of Lakhbandki which is contrary to the condition of giving the bond in the beginning shall be automatically void to that extent.
(5) If the creditor does not enjoy the property given by Lakhbandki according to this paragraph, the deed of Lakhbandki shall be null and void.
